The short story is Dr Asad Rasa had a website where he complained that Canadians were not good enough for him, I linked to it, copied his 8 reasons why Canuckitude had suckitude, which My attorney seems to agree is no big deal with fair use in Canada or the United States, but Asad day after day sent emails into bluehost until they finally shut me down, presumably when a lawyer on Asad’s behalf called them. Though he’s never mentioned a law firm to anyone I know of. Then in desperation I sent an email out to everyone I could think of. Many linked to at the bottom helped spread the word. Then I got the best lawyer in the free speech business on side. The combined strategies worked, I know Bluehost was probing other blogs carrying the story that made them look like schmucks. Websites that they do not host and cannot arbitrarily shut down! I know Ezra said his phone call went well. Now Bluehost has admitted by their actions that they made a mistake. I mean telling me I have no ability to get fair use is insane. However I have been emailed dozens of emails of his threats sent to me and other bloggers, I will treasure them all. They go from hostile to insane later on when he starts telling me to shut down other peoples blogs. Too bad I wasn’t ordered to shut down Dawgs blog or some other lame lefty.
He should have twigged Friday night. That when Bluehost brought my site back up that he didn’t have a legal leg to stand on yet the threats kept coming. I could have called this stupidity off with a couple of snarky posts and moved on. But he has threatened who knows how many bloggers. I’ve seen enough emails where yesterday he said even though M.A.D. is back he’s going to sue for defamation because I don’t have the right to link to his name or his web archive, arg.
So that’s where it stands now. Like an 11,000,000 threat over my head for having the temerity to mention Asad’s name. And he’s going to people telling them that I’m responsible for every post in the blogosphere, telling people to block my IP address for posts they themselves made.

Says the anti free speech thug. Is it really simple? Based on what? You Asad, want to remove my right Number 2 from the Canadian Charter of Rights and Freedoms by telling me what I can and cannot say!
I mean a lot of bloggers are reading what you wrote and saying they agree yes it’s cold here but AGW will save us on that one. So you said something you don’t agree with we all do. Live with it say you no longer agree but don’t bloody well tell me I cant quote you because you don’t believe in fair use.

Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

Am I for profit?
Am I criticizing and commenting on his PUBLIC work?
Am I teaching?
Are bloggers news reporting?
I would say yes to all 4, who other than Asad wouldn’t?
So now I have to continue to pursue legal action against him. As this has gone from a simple request to have my name removed to a clear cut case of slander and defamation. Not sure why he has gone this route? I think he is digging his own grave.

Asad has the right to arbitrarily take your rights away based on what I do not know.

Asad just wants to take those deeply ingrained freedoms away from me, Asad says that taking away my fundamental freedom is a simple matter. If I cannot mention your name in an article you posted on the world wide web I have none of that. Sure it might have been different wherever you came from, but tough you are here. If you don’t want freedom of the press move to Russia or Saudi Arabia, you might be more comfortable.
Asad is the whole immigration thing in a nutshell when you hear people prattle on about bringing in immigrants from the stone ages to a modern and democratic society he is the reason people say it fails. He came here but doesn’t have even the basic concepts, first he wants to keep stoking the fires by threatening 10+ bloggers with legal action. No one thinks he has a leg to stand on. Last week when Bluehost.com disabled his website, he went crazy.

Note He is saying that I started BCF and Binks 2 of my favorite blogs last week. I mean this isn’t just libelous it’s stupid No one not even dawgs blog is going to believe I started BCF last week. This guy would have been good at a Stalinist trial.
